Welcome to Declicy. These Terms & Conditions ("Terms") govern your access to and use of the Declicy mobile application (the "App") and our associated fitness and nutrition coaching services (the "Services") provided by us.
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not download, install, or use the App.
1. Agreement to Terms
By creating an account, you represent that you are at least 18 years of age (or the age of majority in your jurisdiction) and possess the legal authority to enter into this agreement. If you are between 13 and 18, you may only use our Services under the supervision of a parent or guardian who agrees to these Terms.
2. User Accounts & Security
To access the customized features of the App, you must obtain account credentials (usually assigned through your personal coach/trainer). You are responsible for safeguarding your password and account details. You agree to notify us immediately of any unauthorized use or security breaches. We are not responsible for any losses resulting from unauthorized account access.
3. Subscriptions & Payments
Access to tailored workout programs, meal planning, and active coach communication requires an active subscription or coaching arrangement.
• Billing: Billing: Fees are billed in advance, either via standard mobile app store payment processors or directly coordinated through coach portals.
• Cancellations: Cancellations: You can cancel your coaching subscription in accordance with your individual trainer agreements or directly in your device subscription management dashboard.
• Refunds: Refunds: Direct coaching fees and digital subscription purchases are generally non-refundable unless specified otherwise by local consumer laws.

CONSULT A PHYSICIAN: CONSULT A PHYSICIAN: You should consult a medical professional before starting any workout program, dietary program, or using any recommendation shown within the App. This is especially critical if you have any pre-existing health conditions, injuries, or cardiovascular risks.
ASSUMPTION OF RISK: ASSUMPTION OF RISK: By participating in physical exercises or dietary changes guided by the App, you voluntarily assume all risks of injury, health complications, or adverse effects. Declicy and its coaches are not liable for any physical harm, injuries, or health issues resulting from your activities.
5. User Code of Conduct
You agree not to use the App for any illegal or prohibited purpose. You shall not upload malicious code, attempt unauthorized access to databases, or engage in abusive, harassing, or disrespectful behavior in chats with your personal coach or other users.
6. Intellectual Property Rights
All intellectual property, including code, layout designs, exercise demonstration videos, graphics, nutrition guides, and brand symbols (like the Declicy logo) are owned by us or our licensors. You are granted a limited, personal, non-exclusive, non-transferable license to access the App for individual fitness tracking. Copying, republishing, or distributing our intellectual assets is strictly prohibited.
7. Account Termination
We reserve the right to suspend or terminate your account access to the App at our discretion, without notice, if we believe you have breached these Terms or engaged in conduct that harms other users, coaches, or our brand interests. Upon termination, your right to use the App immediately ceases.
8. Limitation of Liability
To the maximum extent permitted by law, Declicy, its affiliates, trainers, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or physical wellness resulting from your access to or inability to use the App.
9. Governing Law
These Terms shall be governed and construed in accordance with local jurisdiction laws, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
